If the defendant has been charged with a felony DUI – as is often the case when there is an accident resulting in injury – there are some small differences in how the proceedings are carried out.
Felony cases must be brought before the court for:
- Arraignment
- Pre-preliminary examination motions
- Preliminary hearing
- Superior Court hearing to determine whether probable cause exists for the charges against the defendant
If the judge determines that there is probable cause, the defendant will be arraigned for a jury trial.
